The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday, November 25, 2009 at 9:00 A.M.

TRANSFER   Application received from Arthur Phillips Mudge, T/A Mudge's Tavern, 400 N. Bridge Street, Elkton, MD 21921 for transfer of Class "B" Beer, Wine & Liquor Alcoholic Beverage License No. B-28 from J. Lee Younce, Jr., Member, Lee LLC, (Owner); 400 N. Bridge Street, Elkton, MD 21921


Arthur (Phil) Mudge appeared before the Board the applicant was duly sworn by the Clerk.  Mr. Wilson read the public notice which appeared on dates of November 13 and 18, 2009.  The fully executed application packet with proper fees included: signatures of 10 registered voters and property owners in District 3-2; Alcohol Awareness Training; Certification Form stating the nature of the business will be a package goods store; Validation for Sunday Sales requesting off-premises sales only; Worker's Compensation.  Mr. Wilson asked the applicant if the questions that he answered as part of the application packet were true today as when he signed the application; the applicant stated yes.  Mr. Mudge stated settlement will occur on December 1, 2009 and it will be a local neighborhood bar with cold sandwiches, clubs, frozen pizza, soups, crock pots, he does not intend on having a hood or fried foods. Ms. Coyle stated the Comptroller has requested he get his CR number before the license is issued.  Mr. Gerweck made a motion to approve the transfer conditioned upon settlement and the applicant getting his CR number; Mr. Curry seconded that motion and the Board then voted unanimously to approve the transfer of the license.


VIOLATION – Sales to person under the age of 21 - Sachin N. Patel, President; Terry S. Grubb, Resident Agent; Subham, Inc., T/A Elkton Liquor Warehouse, Southfield Park Center, Elkton, MD 21921


Sachin Patel appeared before the Board with Adrian Vasquez and attorney Jason Allison; they and Chief Bradford were duly sworn by the Clerk.  Mr. Bradford read his report into the record.  Mr. Allison stated all employees are TIPS trained and Mr. Vasquez has been scheduled for the class.  Mr. Vasquez stated he had asked for Robert C. Nichols' ID and he responded that he did not have it as he has a DUI and Mr. Vasquez stated he figured he was okay since Nichols was a senior when he was a freshman in high school.  Mr. Snelling stated they will receive a certified letter with the Board's Decision.


BOARD DECISION – Admitted guilt – $250 fine and cost of the proceedings of $250.

·                     Casino - The Board would like to meet with the Legislation when they meet with the Commissioners on December 10.  Earl will make arrangements for this.
