MINUTES OF THE BOARD OF COUNTY

COMMISSIONERS MEETING

 

April 20, 2004

 

            The Board of County Commissioners for Cecil County met in regular session on Tuesday, April 20, 2004 at the North East Town Hall, 106 South Main Street, North East, MD.  The following members of the Board were present:

 

            Nelson K. Bolender, President

            Phyllis Kilby, Vice President

            Harry A. Hepbron, Commissioner

            William C. Manlove, Commissioner

            Mark H. Guns, Commissioner

 

constituting a full Board.

 

            The meeting was called to order by President Bolender at 7:00 p.m. and opened with the Pledge of Allegiance.

 

            The minutes from the April 6, 2004 meeting of the Board of County Commissioners were unanimously approved.

 

            The minutes from the April 6, 2004 Board of Health of the Board of County Commissioners were unanimously approved.

 

-          PUBLIC HEARING –  AGRICULTURAL PRESERVATION DISTRICT -

 

Jocelyn Beland, Planner, Office of Planning & Zoning presented the Board an application for the establishment of an Agricultural Preservation District. Property Location: N/S Crystal Beach Road, Earleville, MD. Tax Map:  58, Grid 17, Parcel: 72, Acreage:  273.588 Acres, 1st Election District. Property Owner:  John F. Coleman. Presently Zoned: Southern Agricultural Residential, (SAR).

 

COMMENTS IN SUPPORT:  None

 

COMMENTS IN OPPOSITION: None

 

            Motion was made by Vice President Kilby, seconded by Commissioner Manlove and unanimously carried to approve the application for the establishment of an Agricultural Preservation District, pursuant to the request of John F. Coleman.  

 

-          COMMISSIONERS COMMENTS –

 

President Bolender – read a statement relating to the April 6, 2004 Meeting of the Board of County Commissioners which dealt with procedures, decorum and guidelines to be followed at future meetings.

 

Vice President Kilby – commented relative to the Spring Fest Event to be held on May 1, 2004 at the Fair Hill Nature Center and the March of Dimes Walk scheduled for May 8, 2004 at the North East Park.

 

Commissioner Hepbron – declined comment.

 

Commissioner Manlove – declined comment.

 

Commissioner Guns – commented relative to the Inspiration Walk for Special Olympics recently held at the North East State Park.

 

-          TREASURER’S REPORT –

 

Pamela Howard, Treasurer for Cecil County presented the monthly Treasurer’s Report for the period ending March 31, 2004.  A copy of which is incorporated into these minutes.  In addition, Treasurer Howard outlined new procedures relating to the annual tax sale that will take place in June.

 

-          PRESENTATION – WAPITI  WILDERNESS RETREAT CENTER –

 

Mr. Mark Retz, representing the Episcopal Diocese of Pennsylvania, presented the Board with an overview of the Wapiti Retreat Center, planned for property located on the Elk River in North East, off of Turkey Point Road.  Mr. Retz outlined the property description; facility purpose; customer base and development plan; as well as the effects on North East and Cecil County commerce.  He further described the intent of the project, conservation values and the economic impacts this center will provide.

 

-          PUBLIC COMMENT –

 

Robin Dahl, 18 Walden Court, North East, President of the Lakeside Community Association – commented relative to the relationship with the assistance of the Office of the County Commissioners that association has built with the residents and youth of Lakeside Trailer Park.  Ms. Dahl highlighted some of the events that have taken place in the community as a result of this collaboration and requested the Commissioners continue the working relationship as there is much more to be accomplished. 

 

Joyce Bowlsbey, 73 Laurel Run Rd., Elkton, MD, representing the Cecil County Chamber of Commerce – commented relative to the April 6, 2004 Board of County Commissioners’ Meeting and the voting process which took place.  Ms. Bowlsbey stressed the importance of equal representation at meetings, when there are important issues discussed and voted on.

 

Joseph Bruckner, Cecil Woods, North East, made an inquiry as to the progress of a recent agreement between the Board of County Commissioners and Mechanics Valley LLC and their work on Route 40.

 

-          RESOLUTION – WINDING BROOK SPECIAL TAXING DISTRICT –

 

Mr. Alfred C. Wein, Jr., County Administrator, presented to the Board a Resolution pursuant to Article IV, Chapter 75 of the Code of Cecil County empowering a levy of a special assessment upon the “Winding Brook Special Taxing District” to pay costs of trash collection, mowing of common areas, and general maintenance in the development of Winding Brook, in the amount of $135.00 per lot for the fiscal year commencing July 1, 2004 and ending June 30, 2005.

 

Motion was made by Commissioner Guns, seconded by Vice President Kilby and unanimously carried to approve the Resolution relating the Winding Brook Special Taxing District.  

 

-          AGREEMENT  BETWEEN THE COMMISSION ON AGING FOUNDATION AND THE CECIL COUNTY DEPARTMENT OF AGING – HEALTHY LIFESTYLES FITNESS CENTER –

 

Administrator Wein, presented the Board with an Agreement between the Commission on Aging Foundation and the Cecil County Department of Aging (Cecil County Government).  As part of this agreement, the Commission on Aging Foundation agrees to pay the rent for the Healthy Lifestyles Fitness Center for one year.

 

-          WAIVER OF FEES, DELAWARE VALLEY AFFORDABLE HOUSING –

 

Administrator Wein presented a letter from Mr. George Beer, President of Delaware Valley Development Company, requesting a waiver of the building permit and certificate of occupancy fees’ for the proposed 72 unit Stony Run Apartments. 

 

            Motion was made by Vice President Kilby, seconded by Commissioner Guns and unanimously carried to approve the waiver of building permit and occupancy fees for the proposed Stony Run Apartments

 

-          BUDGET AMENDMENTS –

 

Upon the recommendation of Administrator Wein, motion was made by Commissioner Manlove, seconded by Commissioner Hepbron and unanimously carried to approve Budget Amendments 159 – 162.

 

The next meeting of the Board of County Commissioner’s is scheduled for May 4, 2004 at County Administrative Building, 107 North Street, Elkton, MD.

 

There being no further business, the Board of County Commissioner’s Meeting was adjourned.
