REZONING HEARING
March 4, 2003
The Board of County Commissioners of Cecil County met in regular session at the County Administrative Building 107 North Street, Elkton, MD on Tuesday, March 4, 2003. The following members were present:

The meeting was called to order by President Bolender at 2:00 p.m.

- SARINA, INC. REZONING
FILE NO. 2003-01 – APPLICANT: Sarina, Inc., by Jay C. Emery, III, Esquire. PROPERTY LOCATION: 39 Elwoods Road – South of Bay View, North East, MD, Election District: 5, Tax Map: 25, Parcel 16. PRESENTLY ZONED: Business General, (BG) & Development Residential, (DR). REQUEST: Rezone 6.609 from Business General, (BG) & Development Residential (DR) to Business General, (BG) for the proposed use of Hotel/Motel or any other use permitted in a Business General, (BG) zone. PROPERTY OWNER: Sarina, Inc.
County Administrator Wein swore in all witnesses.
Jay C. Emery, III, Attorney and Mr. B. Patel appeared before the Board to present testimony.
Mr. Emery described the location of the property and referred to current zoning maps, the parcel in question is parcel 16, which is zoned (BG). However, a portion of the parcel is zoned (DR) Development Residential and is labeled as parcel 15. Mr. Emery proffered to the Board that parcel 15 actually does not exist, and is a mapping error, as a result of the 1993 Comprehensive Plan. The portion of parcel 16 that was zoned (DR) was incorrectly labeled as parcel 15. Additionally, Mr. Emery consulted assessment maps and has verified that parcel 15 does not exist. Therefore, he is requesting the remaining portion of the parcel (6.609 acres) that is currently zoned (DR) be rezoned (BG) for the purposes of constructing a hotel/motel on the site.
Eric Sennstrom, Director Planning, Zoning, Parks & Recreation, indicated that the Planning Commission recommended approval of this rezoning at their February 24, 2003 meeting.
Mr. Sennstrom read the Finding of Fact for file 2003-01. A copy is attached to the minutes.
A motion was made by Commissioner Hepbron to approve the rezoning application submitted by Sarina, Inc., Commissioner Guns seconded the motion, motion carried.
