REZONING HEARING

February 3, 2004

 

 

 

 

          The Board of County Commissioners of Cecil County met in regular session at the County Administrative Building 107 North Street, Elkton, MD on Tuesday, February 3, 2004.  The following members were present:

 

            Nelson K. Bolender, President

            Harry A. Hepbron, Commissioner

            William C. Manlove, Commissioner

            Mark H. Guns, Commissioner

 

            Constituting a majority Board.

 

            The meeting was called to order by President Bolender at 5:00 p.m. and opened with the Pledge of Allegiance.

 

Carol Beresh, Court Reporter, Circuit Court, 129 East Main Street, Elkton, MD, recorded a verbatim transcript of this public hearing.

 

APPLICANT: FILE NO. 2004-01 Paris M. Miller; Property Location: 546 Mechanics Valley Road, North East, MD; 5TH Election District; Presently Zoned: Development Residential (DR); Request: Rezone .42 Acres from Developmental Residential (DR) to Business General (BG) for the purpose of a Small Business; Property Owner:  Paris Miller

 

            Administrator Wein swore in all witnesses.

             

            Mrs. Paris Miller and her daughter, Cheri Long appeared before the Board and requested a zoning change for the property located at 546 Mechanics Valley Road, North East, MD.  Mrs. Miller stated that she believes there was a mistake in the 1993 Comprehensive Rezoning.  Mrs. Miller stated that her property is surrounded by businesses and for resale purposes would like to have it rezoned to Business General (BG).

 

            Mr. Eric Sennstrom advised the Board that staff recommended approval, based upon a mistake in the 1993 Comprehensive Rezoning.

 

            Planning Commission recommended approval, based upon a mistake in the 1993 Comprehensive Rezoning.

 

            Mr. Sennstrom read the Finding of Facts for file 2004-01.  A copy of the Finding of Facts is incorporated into these minutes.

 

            Motion was made by Commissioner Hepbron, seconded by Commissioner Guns and unanimously carried to approve the rezoning for File No. 2004-01 from Developmental Residential (DR) to Business General (BG).
