Amendment to Cecil County Code

Chapters 134 – Commercial Refuse Haulers; Chapter 228 – Solid Waste Disposal &

Chapter A279 Recycling Plan

Public hearing will be held by the Board of County Commissioners of Cecil County on May 4, 2010; 7:00 p.m. at the County Administration Building, 200 Chesapeake Blvd., Elkton, MD  to repeal and reenact Chapters 134 – Commercial Refuse Haulers; Chapter 228 – Solid Waste Disposal & repeal Chapter A279 Recycling Plan of Code of Cecil County.

Copies of the proposed ordinance may be viewed on the Cecil County Government website at ccgov.org or by contacting the Department of Public Works, Solid Waste Management Division at 410.996.6275. The following is a summary of the proposed changes:

            Chapter 134 – Commercial Refuse Haulers:

·         Repeals and replaces Chapter 134 with new, updated language and provisions.

·         Assigns responsibility for the licensing of commercial refuse haulers to the Cecil County Department of Public Works.

·         As a condition of obtaining and maintaining a Cecil County Commercial Refuse Hauler's License, commercial refuse haulers who collect residential refuse will be required to provide their residential customers with curbside pickup of single stream targeted recyclables at least once every two weeks.

Chapter 228 – Solid Waste Disposal:

·         Repeals and replaces Chapter 228 with new, updated language and provisions.

·         Incorporates and updates information regarding the County Recycling Program which was previously included in Chapter A279 of the County Code, which is being proposed for repeal.

·         Establishes a separate schedule for operating days and times for the County landfill and transfer stations.

·         Establishes a separate fee schedule which proposes to increase the refuse tipping fee, establish a separate tipping fee for the disposal of construction and demolition debris, establish and increase fees for residents who self-haul their refuse, recyclables, and/or green waste to the landfill and/or transfer stations, and makes other changes to various fees. 

·         Amends the penalties for violations of the rules and regulations pertaining to the operation of the County's solid waste disposal facilities.

Chapter A279 – Recycling Plan:

·         Repeals Chapter A279. (The content of Chapter A279 is incorporated into the proposed revision to Chapter 228.)
