MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY
The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday, February 27, 2013 at 9:15 A.M.

TRANSFER OF LICENSE
Application received from Raymond Walters, President; Valerie Walters, Vice President; Brock Juergens, Board Member; Walt's Tavern LLC, T/A Walt's Tavern, 307 Augustine Herman Highway, Suite 103, Elkton, MD 21921 for transfer of Class "B" Beer, Wine & Liquor Alcoholic Beverage License No. B-139 from Stephen Slack, Member; Arnold Gilbert; Captain Slack's LLC, T/A Captain Slack's, 301 Augustine Herman Highway, Southfield Park, Suite 103, Elkton, MD 21921
Raymond Walters and Brock Juergens appeared before the Board; the applicants were duly sworn by the Clerk. Mr. Wilson read the public notice which appeared on dates of Wednesday, February 13 and 20, 2013. The fully executed application packet with proper fees included: signatures of 10 registered voters and property owners in District 3-3; Alcohol Awareness Training showing they have taken the class; Certification Form stating the nature of the business will be 'We are a tavern in a strip mall. Our goal is to provide a safe fun environment for adults to enjoy themselves. We will provide adult beverages." Mr. Wilson asked each applicant if the information submitted on the application is true today as when they signed it January 31, 2013, the applicants stated yes. Chairman Snelling asked if they would be operating in the same manner; Mr. Walters stated yes, but will eventually be serving more food. Chairman Snelling asked if they would be upgrading the kitchen; Mr. Walters stated there is no exhaust system and they believe the business next door when they renew their lease. Commissioner Taylor made a motion to approve the new license conditioned upon receiving the release for the taxes from the Comptroller's Office; Commissioner Eller seconded that motion and the Board then voted unanimously to approve the transfer conditioned upon receiving the release for the taxes from the Comptroller's Office.
Application received from Devin Saunders, Managing Member; Paul Darring, Member; Black & White Restaurant, LLC, T/A Black & White Restaurant, 989 E. Pulaski Highway, Elkton, MD 21921 for issuance of new Class "B" Beer, Wine & Liquor Alcoholic Beverage License.
Devin Saunders and Paul Darring appeared before the Board with attorney, William F. Hickey, III; applicants were duly sworn by the Clerk. Mr. Wilson read the public notice which appeared on dates of Wednesday, February 13 and 20, 2013. The fully executed application packet with proper fees included: signatures of 10 registered voters and property owners in District 3-1; Alcohol Awareness Training showing they have taken the class; Certification Form stating the nature of the business will be "Black and White will serve from scratch food in a family friendly atmosphere including a place for adults to relax to smooth listening." Mr. Wilson asked each applicant if the information submitted on the application is true today as when they signed it February 1, 2013, the applicants stated yes. The applicants stated their projected opening date is March 15; they would eventually like to utilize the patio in the back with four 4-top tables, with no outdoor music. Chief Bradford asked if they needed to have a new occupancy permit, Mr. Darring stated no; Chief Bradford stated the Board would need copies of any inspections, approvals or permits they received. Commissioner Eller made a motion to approve the new license; Commissioner Taylor seconded that motion and the Board then voted unanimously to approve the issuance of the new license.

· Catering Events
o HB1366 – this bill introduces the state-wide license allowing grocery stores, chain stores, etc to sell beer and wine – Chairman Snelling stated he has always opposed grocery stores having a license and if this bill is approved it will destroy small business; he stated he is taking a strong stance against this. Commissioner Eller agreed with Chairman Snelling; Commissioner Taylor stated she would have to research it before she had an opinion.
o Beer Growler legislation – passed the Senate and was introduced in the House on Monday
· Operation Stay Alert – Chief Bradford stated at this time they have visited 73 establishments and 33 have sold; he also stated they went to Stop & Shop the Friday after the January meeting and they sold, this makes the last six times they have visited them that they have sold.
· MSPF – Maryland State Prevention Framework Grant – Chief Bradford stated we have been approved for $18,000 from the MSPF grant – it has taken two years for the approval; these funds will be utilized for $12,000 for PT salaries, $3,000 for supplies and $3,000 for travel; we will also be holding the Fraudulent ID training for licensees again in October.
With no further business to discuss, the meeting was adjourned at 9:45 AM.
