The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday, January 27, 2010 at 9:00 A.M.

TRANSFER - Application received from Denise Methven, President; Unwined, LLC, T/A Unwined, 472 North Mauldin Avenue, North East, MD 21901 for transfer of Class "B" Beer, Wine & Liquor Alcoholic Beverage License No. B-99 from Felicia Marie Covatta, President/Secretary/Treasurer; Matthew Price Trainer, Vice President; A. Covatta 2, Inc., T/A Bay Gourmet,472 N. Mauldin Avenue, North East, MD 21901

 Denise Methven appeared before the Board with attorney, Bob Jones.  Mrs. Methven was duly sworn by the Clerk.  The fully executed application packet with proper fees included: Zoning Certificate signed by Clifford Houston, Cecil County Office of Planning & Zoning; signatures of 10 registered voters and property owners in District 5-4; Alcohol Awareness Training; Certification Form stating the nature of the business will be a restaurant, bar, liquor store; Worker's Compensation.  Mr. Wilson asked the applicant if the questions that she answered as part of the application packet were true today as they were when she signed the application; the applicant stated yes.  Mrs. Methven stated she plans to have an upscale bar featuring wine, craft beer, martinis and lite fare and maybe one day serve dinner.  She stated the hours of operation will be from 11:00 AM until the last patron, but no later than 1:00 AM.  She said they are renovating the interior; they hope to have the work complete the last week in February and be ready to open the first week of March.  The Board reiterated the Sunday Sales license requirement.  With no questions from the Board; Mr. Gerweck made a motion to approve the transfer of the alcoholic beverage license conditioned upon settlement and submitting the Affidavit of Transferor; Mr. Curry seconded that motion and the Board then voted unanimously to approve the issuance of the license. 

 UPDATE – License Not Issued – Class "B"BWL Alcoholic Beverage License No. B-131 - Sarah Davis, T/A 3-D, 300 East Pulaski Highway, Elkton, Maryland 21921

 Bryan Davis appeared before the Board; he stated he missed the December meeting because he believed the meetings were held the last Wednesday of the month and for December the Board met a week earlier.  He is having trouble with the Town of Elkton as they will not allow him to work on the interior of the building until the parking lot repairs are complete.  There was a discussion regarding the issues he has faced with the Town.  He asked the Board to reinstate the license for 3-D based on the trouble he is having; Mr. Gerweck made a motion to reinstate the license as long as he pays the renewal fees and appears in April to update the Board; Mr. Curry seconded that motion and the Board then voted unanimously to approve the reinstatement of the license.

UPDATE – Ownership/Lease Management Agreement – Class "B BWL Alcoholic Beverage License No. B-41 - Jurgen Michael McGuigan, Member; Franklin Strimel, Member; Rendezvous Inn, Inc., T/A Rendezvous Inn, 362 Front Street, Perryville, MD 21903

 Frank Strimel appeared before the Board.  Chief Bradford explained to the Board that Mr. Strimel and Mr. McGuigan came to the office and wished to add Mr. Strimel to the license; a few days later Mr. McGuigan came back to the office and wanted to be taken off the license.  Chief Bradford explained they will need to submit a copy of their corporate bylaws that state they do not need three members on the alcoholic beverage license; the percentage of ownership for each member and a lease management agreement with Mr. Strimel.  Chief Bradford stated he is concerned that there are four members of the corporation with a financial interest, however they do not wish to have anyone with financial interest on the license.  Mr. Strimel stated he is managing the restaurant at this time.  He may look to purchase it in the future.  The Board requested the appropriate documentation by March 19th so the license can be properly renewed.

 UPDATE – License Not Issued - Arthur Phillips Mudge, Mudge LLC, T/A Mudge's Tavern, 400 Bridge Street, Elkton, MD 21921

 Mr. Mudge called the Board office and stated he was unable to get funding and is withdrawing his application.
