MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY

 

The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday September 30, 2009 at 9:00 A.M.

PRESENT:
             Tim Snelling, Chairman
                                Herrell 'Cuz' Curry, Commissioners
                                William Gerweck, Commissioner
                                H. Norman Wilson, Jr., Esquire
                                Earl R. Bradford, Chief Alcohol Beverage Inspector
                                Robin Coyle, Administrative Assistant

 

VIOLATION – Sales to a person under the age of 21 - Sangeeta M. Manekporia, Owner; Stop & Go Enterprises, Inc.,T/A Stop and Go, 1 East Cecil Avenue, North East, MD 21901

 

Sangeeta Manekporia appeared before the Board; the applicant and Chief Bradford were duly sworn by the clerk.  Chief Bradford read his report into the record.  Mr. Wilson asked the Board if they had any questions of Chief Bradford; they did not.  Mr. Wilson asked Mrs. Manekporia what has transpired at her establishment since this time; she stated they usually check everyone for ID, they were busy and failed to check for ID.  She stated she's had family issues and has been in Canada taking care of her parents.  Mr. Snelling asked if all employees have had TIPS training; Mrs. Manekporia stated Mr. Singh has not.  Mr. Gerweck asked if Mr. Singh understands the ramifications to the business; Mrs. Manekporia stated yes, he feels bad.  Mr. Snelling asked if she was aware of Operation Stay Alert and received the paperwork that was left; she stated she wasn't sure, she will check.  Ms. Coyle stated there are no previous violations.  Mr. Snelling stated she will receive a certified letter with the Board's Decision.

 

BOARD DECISION – Admitted guilt – $250 fine and cost of the proceedings of $250.

 

VIOLATION– Sales to a person under the age of 21 - A. Chad Johnston, Member; Karnail Singh, Member; USA Liquors, LL T/A Johnston's Discount Liquors, 1170 Rock Springs Road, Conowingo, MD 21918

 

Karnail Singh appeared before the Board with Maghar Singh; they and Chief Bradford were duly sworn by the Clerk.  Chief Bradford read his report into the record.  Mr. Wilson asked the Board if they had any questions of Chief Bradford; they did not.  Mr. Snelling stated this was a follow-up for Operation Stay Alert; he asked if the information was left with the Clerk; Chief Bradford stated the clerk was the licensee.  Mr. Singh stated this was their first time, he has family sick and he tells his employees no matter what check ID, if they don't have ID don't sell.  He also stated he has a card checking machine, but it was not used.  Mr. Snelling stated they will receive a certified letter with the Board's Decision.

 

BOARD DECISION – Admitted guilt – $250 fine and cost of the proceedings of $250.

 

VIOLATION– Sales to a person under the age of 21 – Charles Evan Rollins; Kyle A. Rollins; Lisa A. King; Alibi Inn, LLC, T/A Alibi Inn, 2 Sassafras Road, Warwick, MD 21912

 

Evan Rollins appeared before the Board with manager, James Baughman; they and Chief Bradford were duly sworn by the Clerk.  Chief Bradford read his report into the record.  Mr. Wilson asked the Board if they had any questions of Chief Bradford; they did not.  Mr. Snelling stated this was a follow-up for Operation Stay Alert; he asked if the information was left with the Clerk; Chief Bradford stated that Mr. Baughman was present at the end of that visit and was aware of the events that occurred.  Mr. Gerweck stated this was the second violation in a year.  Mr. Rollins asked Mr. Baughman several questions, including his job duties and if he was working August 21st when this violation occurred; Mr. Baughman stated yes.  Mr. Baughman explained there were other things going on inside the bar that needed his attention and when he saw someone at the counter in the package store, he went over and rang it up; he stated the agent John Ball looked familiar, and he believed he had been there before and had served him before.  The Board asked John Ball to come to the front; he was sworn by the Clerk.  The Board asked him if he had ever been to the Alibi and he stated no; they then asked Mr. Baughman if it were possible to successfully run both operations and Mr. Baughman stated yes, usually the bartender takes care of the bar and the store, but he will make sure the package store is covered and they ask for ID.  Mr. Snelling stated they will receive a certified letter with the Board's Decision.

 

BOARD DECISION – Admitted guilt – $1.000 fine and cost of the proceedings of $250.

 

VIOLATION – Open After Hours Set for Closing - Robert A. Archibald, President; Carla Beaston, Member; A.J. Jokers, Inc., T/A A.J. Jokers, 216 W. Pulaski Highway, Elkton, MD 21921

 

Robert Archibald appeared before the Board; he, Chief Bradford and Inspector Reynolds were duly sworn by the Clerk.  Chief Bradford read Inspector Reynolds' report into the record.  Mr. Archibald stated they were having their mid-summer Nascar party that day.  Mr. Snelling stated they will receive a certified letter with the Board's Decision.

 

BOARD DECISION – Admitted guilt – $250 fine and cost of the proceedings of $250.

 

UPDATE – No alcohol on premises - Adam I. Kelso, Owner; T/A Bull Dog Pub, 1205 Tome Highway, Port Deposit, MD 21904

 

Adam Kelso appeared before the Board; he stated he has been renovating the establishment and they were closed for winter and had not opened yet, however they did open as of Tuesday selling alcohol.  The Board reminded him he needs to remain open for the sale of alcohol for 30 consecutive days.

 

LEASE MANAGEMENT AGREEMENT - Bayard Montgomery, President; Bay Mont Enterprises, Inc., T/A Custard's Last Stand/Townhouse Restaurant, 100 Ryan Drive, Rising Sun, MD 21911

 

Gerald Fuller appeared to meet the Board for the lease management agreement.  Mrs. Fuller explained they are currently closed however they will be serving barbecue sandwiches, etc. with bottle beer and wine only.  She stated they will be open Thursday and Friday for their catering customer and open to the general public on Saturday.  The Board voted to approve the change of trade name to Old South Smoke House and then approved the lease management agreement.
