MINUTES OF THE BOARD OF LICENSE COMMISSIONERS
OF CECIL COUNTY

The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Wednesday August 26, 2009 at 9:00 A.M.

License Reclassification - Application received from Ashok Maganbhai Patel, President, Ila Ashok Patel, Vice President, Robert Valliant Jones, Resident Agent, Amit Inc., T/A Schroeder's Liquors, Class "A "Off Premise Sales Beer, Wine & Liquor Alcoholic Beverage License 479 North East Road, North East, MD. 21901 for reclassification of Class "B" On - Off Premise Sales Beer, Wine & Liquor Alcoholic Beverage License No. B-47 from Ashok Maganbhai Patel, President, Ila Ashok Patel, Vice President, Robert Valliant Jones, Resident Agent, Amit Inc., T/A Schroeder's Liquors, 479 North East Road, North East, MD. 21901

 

Ashok and Ila Patel appeared before the Board with attorney Bob Jones; the applicants were duly sworn by the Clerk.  Mr. Wilson read the public notice which appeared on dates of August 12 and August 19, 2009.  The fully executed application packet with proper fees included: Zoning Certificate signed by Cliff Houston, Zoning Administrator, Cecil County; signatures of 10 registered voters and property owners in District 5-1; Alcohol Awareness Training; Certification Form stating the nature of the business will be a package goods store; Validation for Sunday Sales requesting off-premises sales only; Worker's Compensation.  Mr. Wilson asked the applicants if the questions that they answered as part of the application packet were true today as they were when they signed the application; the applicants both stated yes.  Mr. Gerweck asked if the <food trailer> out front has been approved by the county, the applicants stated yes.  Mr. Snelling stated the Board has decided to waive the $1,000 reclassification fee, however, if they reclassify again, they will need to pay the fee at that time.  Mr. Gerweck made a motion to approve the reclassification of the alcoholic beverage license; Mr. Curry seconded that motion and the Board then voted unanimously to approve the reclassification of the license. 

 

License Transfer - Application received from Rita S. Patel, President, Richard Anthony Shelby, Registered Agent, Shree Sai Liquors Inc., T/A Elk Landing Beer Wine & Spirits, 218 West Pulaski Highway, Elkton MD. 21921 for transfer of Class "B" Beer, Wine& Liquor Alcoholic Beverage License No. B-107 from Jack Beaston Owner, Elk Landing Beer Wine & Spirits, 218 West Pulaski Highway, Elkton MD. 21921

 

Rita Patel and Richard Shelby appeared before the Board with attorney Jason Allison; the applicants were duly sworn by the Clerk.  Mr. Wilson read the public notice which appeared on dates of August 12 and August 19, 2009.  The fully executed application packet with proper fees included: Zoning Certificate signed by Craig Trostle, Zoning Administrator, Town of Elkton; signatures of 10 registered voters and property owners in District 3-3; Alcohol Awareness Training stating they will take the next available class; Certification Form stating the nature of the business will be a package goods store; Validation for Sunday Sales requesting off-premises sales only; Worker's Compensation.  Mr. Allison posed questions to the applicants as set forth in the alcoholic beverage license application.  Mr. Gerweck made a motion to approve the transfer/reclassification of the alcoholic beverage license conditioned upon settlement occurring, notification letters be sent out and responses received, proper permits, Board Inspection; Mr. Curry seconded that motion and the Board then voted unanimously to approve the reclassification and transfer of the license. 

 

Update - Class "B" Beer, Wine & Liquor License No. B-102 - Lance Grayson Mitchell Rowe, Member; Hook, Line & Sinkers, LLC, T/A Pickled Herring, 10 South Main Street, North East, MD 21901

 

Lance Rowe appeared before the Board with attorney Karl Fockler.  They explained they have met with the Town of North East and the other powers to be, including Chief Bradford.  They permit should be available by Friday (August 28) and they should begin construction the following Monday.  They requested a 60-day extension.  Mr. Gerweck made a motion to approve the request for a 60-day extension; Mr. Curry seconded that motion and the Board then voted unanimously to approve the 60-day extension.

 

License Transfer - Application received from John C. Hahn Jr., Resident Agent, Christopher C. Hahn, Member, Hahn Investments LLC., T/A Hahn's, 145 East Main St., Cecilton, MD. 21913 for transfer of Class "B" Beer, Wine& Liquor Alcoholic Beverage License No. B-103 from Edward Zebley, President, Sally Zebley, Vice President, Neeld Inc., T/A Little Orkie's Pizzeria & Eatery, 145 East Main St., Cecilton, MD. 21913

 

John Hahn, Jr. and Christopher Hahn appeared before the Board; the applicants were duly sworn by the Clerk.  Mr. Wilson read the public notice which appeared on dates of August 12 and August 19, 2009.  The fully executed application packet with proper fees included: Zoning Certificate signed by Brenda Cochran; signatures of 10 registered voters and property owners in District 1-1; Alcohol Awareness Training stating they will take the next available class; Certification Form stating the nature of the business will be a package goods store; Validation for Sunday Sales requesting off-premises sales only; Worker's Compensation.  Mr. Wilson posed questions to the applicants as set forth in the alcoholic beverage license application.  Mr. Gerweck made a motion to approve the transfer/reclassification of the alcoholic beverage license conditioned upon settlement occurring, notification letters be sent out and responses received, proper permits, State of MD acceptance of the LLC, Board Inspection; Mr. Curry seconded that motion and the Board then voted unanimously to approve the reclassification and transfer of the license. 

 

 

Update - Class "B" Beer, Wine & Liquor License No. B-36 – Xianting (Charles) Cao; Diane Stringer; Schaefer's Canal House Restaurant & Market, Inc. 208 Bank Street, Chesapeake City, MD 21915

 

Charles Cao appeared before the Board with attorney Frank Shaulis.  Mr. Wilson stated that based on the mutual agreement, the appeals for the B-36 and B-56 licenses would be dropped and the Board would then issue a new license to the establishment to cover the entire premises at 208 Bank Street, Chesapeake City.  There was a discussion regarding the renewal fee plus subsequent late fees of $2,400 versus paying for a new license which the fee would be $4,250.  The Board stated the license must be paid for within 60-days and the office will hold the license until the premises is ready to open for business, which must be within 11 months of this date.
