MINUTES OF THE BOARD OF LICENSE COMMISSIONERS

OF CECIL COUNTY

 

The Board of License Commissioners of Cecil County met in a regular session at the County Administrative Building, Conference Room, 200 Chesapeake Boulevard, Elk Room, Elkton, MD on Tuesday, January 29, 2008 at 9:25 A.M.

 

PRESENT:      Tim Snelling, Chairman

                   Herrell 'Cuz' Curry, Commissioners

                   William Gerweck, Commissioner

                             H. Norman Wilson, Jr., Esquire

                   Earl R. Bradford, Chief Alcohol Beverage Inspector

                             Robin S. Coyle, Administrative Assistant

 

Chairman Snelling called the meeting at 9:25 AM; he stated Mr. Wilson was tied up with the County Commissioners and would be available for the 9:45 AM hearing.

 

Violation Hearing - Class "B" BWL Alcoholic Beverage License No. B-20 - Todd Stewart, President; Robert E. Stewart, Vice President; Carrie A. Riggs, Secretary; Hotel Port Deposit, Inc., T/A The Winchester Hotel, 15  South Main Street, Port Deposit, MD 21904

 

Todd Stewart appeared before the Board with attorneys Robert Jones and Jason Allison; it was agreed to proceed on a statement of fact.  Chief Bradford and Todd Stewart were duly sworn by the Clerk; Chief Bradford read Port Deposit Police Department Officer Randall C. Giles' report.  On 01/04/08 at 2:17 AM he was responding to a loud music report at Winchester's; he observed "three patrons consuming beers at the bar".  Mr. Jones stated that Mr. Stewart was in a management agreement with Arvie Wrang, he has been released from that agreement; his plan is to take over himself.  Mr. Stewart stated he has been activated in the military and is planning to retire sometime in 2008.  He would like to turn over the license to the Board temporarily until he can do this; Chief Bradford explained that we do have an application on the pending list and if Mr. Stewart turns over the license we would have to hear that application; he continued that he had until January 22, 2009 to be open, worse case scenario. 

 

Chairman Snelling stated he would receive a registered letter regarding their decision.

 

Board Decision - 30 Day Suspension plus $250 Proceedings Cost

 

Violation Hearing - Class "B" BWL Alcoholic Beverage License No. B-126 - Christina Shelby, Member; Bizzy B, Inc., T/A Excellent Convenience Store, 1486 Perryville Road, Perryville, MD 21903

 

Christina Shelby appeared before the Board with attorneys Robert Jones and Jason Allison; it was decided to proceed with testimony.  Chief Bradford summarized his report for the record.  He stated in the file was a photo of the 18 pack of Coors Light Leslie Alan Price purchased on 01/08/08; this was marked as Exhibit #1.  Also in the file were copies of the senior supplement from the newspaper, one is of 2006, the year in which Price graduated as well as 2004, the year in which Joshua Lee, the owner of the driver's license graduated.  In Chief Bradford's report he stated that the only similarities between the person in the MD Driver's License and Price were that they were both Caucasian and had the same hair color.  Mr. Jones argued that without the driver's license it was hard to dispute this; he also stated the Clerk, Alka Arora is a very small lady and it is hard for her to judge how tall anyone is.  Leslie Price was asked about the ID he used; he stated he was not asked for an ID that night but had been carded about a year before when both the owner and Alka were present.  He stated he has always bought there and buys there regularly about every weekend.  The Board asked if he knows of any other underage persons who get alcohol at the establishment; he stated yes, quite a few.  Mr. Jones again stated he is not arguing that the boy did not get served there; he bought the alcohol and he's under 21, but again reminded the Board without the driver's license it is hard to dispute whether the two look alike.  Mr. Snelling stated that when they approved the license the owner indicated to this Board that he would be purchasing a card reader, he asked Mr. Jones if in fact, he had bought this; Mr. Jones stated he did not know.

 

Chairman Snelling stated he would receive a registered letter regarding their decision.

 

Board Decision - Guilty - $250 Fine plus $250 Proceedings Cost
