Erosion and Sediment Control

When is a grading permit required?

See Section 248-3A; A grading permit is required when disturbance exceeds 5,000 square feet or 100 cubic yards.

When is a lot grading plan required?

Lot grading plan requirements are reviewed on a site by site basis, but are normally required whenever the site has an engineered stormwater management plan and on every new residence.

When is an As-built required?

An As-built is required whenever a lot grading plan is required.

When is an Erosion and Sediment control plan required?

See Section 248-7A; An Erosion and Sediment Control plan is required when disturbance exceeds 5,000 square feet or 100 cubic yards.

When is an Engineered Erosion and Sediment Control Plan required?

An Engineered Erosion and Sediment Control Plan will be required in all instances when a Standard Erosion and Sediment Control Plan for Minor Earth Disturbances is not appropriate. Engineered plans must be signed and sealed by either professional engineers, landscape architects or professional land surveyors licensed in the state of Maryland.

When can I use a Standard Erosion and Sediment control plan?

Both the Department of Public Works (DPW) and the Cecil Soil Conservation District (CSCD) offer Standard Erosion and Sediment Control plans. A Standard Erosion and Sediment Control Plan may be used for projects on a single lot where the owner does not own any adjacent parcels, disturbances are less than 30,000 square feet and 500 cubic yards of earth movement if certain limitations are met.

Is there a difference between the DPW Standard Erosion and Sediment Control plan and the CSCD Erosion and Sediment Control plan?

Yes, the DPW Standard Erosion and Sediment Control Plan may only be used for single residential dwellings. The CSCD Standard Sediment and Erosion Control Plan may be used for any disturbance. Both plans may only be used if all limitations found within the plan are met.

Who do I contact for help with the Standard Erosion and Sediment Control plan?

Contact the Cecil Soil Conservation District at 410-398-4411 (ext. 3) for help with a CSCD Standard Erosion and Sediment Control plan. Contact the Department of Public Works at 410-996-5267 for help with a DPW Standard Erosion and Sediment Control Plan.

When does the Final Lot Grading Inspection occur?

For those projects requiring an As-built, a final grade inspection occurs when the As-built has been received and approved. For those projects not requiring an As-built, the final grade inspection will occur when the Department of Public Works receives the Certificate of Occupancy.

Stormwater Management

Who owns and maintains the stormwater management ponds in my development?
Stormwater management ponds belong to the Homeowners  Association (HOA) affiliated with your development. The ponds maintenance is the responsibility of the (HOA).

What is Stormwater Management?
"Stormwater Management" means:(a) For quantitative control, a system of vegetative, structural, and other measures that control the increased volume and rate of surface runoff caused by man-made changes to the land; and (b) For qualitative control, a system of vegetative, structural, and other measures that reduce or eliminate pollutants that may otherwise be carried by surface runoff.

What are the determining factors in deciding whether or not stormwater management will be required?
See Section 251-4 of the Cecil County Stormwater Management Ordinance.

Are there any instances in which stormwater management will not be required at all? Partially required?
See Section 251- (5), (6), (7), and (8) of the Cecil County Stormwater Management Ordinance.

What is required if it is determined that stormwater management is needed?
See Section 251-13 of the Cecil County Stormwater  Management Ordinance.

Who can prepare a stormwater management plan?
