MINUTES OF THE BOARD OF COUNTY

COMMISSIONERS MEETING

September 18, 2007

 

 

            The Board of County Commissioners for Cecil County met in regular session at the Port Deposit Town Hall, 64 S. Main Street, Port Deposit, MD.  The following members of the Board were present:

 

            Mark H. Guns, Vice President

            Rebecca J. Demmler, Commissioner

            Brian Lockhart, Commissioner

            Wayne L. Tome, Sr., Commissioner

 

Constituting a majority Board.

 

            The meeting of the Board of County Commissioners for Cecil County, September 18, 2007 was called to order by Vice President Guns at 7:00 p.m. and opened with the Pledge of Allegiance.

 

            The minutes from the September 4, 2007 meeting of the Board of County Commissioners were unanimously approved.

 

            -COMMISSIONERS' COMMENTS-

 

Commissioner Lockhart - offered no comment.

 

Commissioner Demmler - thanked the Town of Port Deposit for hosting the meeting.

 

Commissioner Tome - commented about the progress within the Town of Port Deposit under the capable leadership.  He also commented in support of the cost of living raise for the county employees that will be presented this evening.

 

Vice President Guns - stated that President Manlove is attending the Rural Community Development Conference in Hershey, PA and will not be able to attend the meeting.

 

-          TREASURER'S REPORT -

 

Pamela Howard, Treasurer for Cecil County presented the Treasurer's Report for the period ending August 30, 2007.  A copy of this report is incorporated into these minutes.

           

-          PUBLIC HEARING -  NOMINATION FOR HISTORIC DESIGNATION - ELK FORGE BED & BREAKFAST -

 

            Eric Sennstrom, Director of Planning & Zoning, presented a Nomination for Historic Designation for the Elk Forge Bed & Breakfast filed by the owners Harry & LeAnn Lenderman.  The property is located at 807 Elk Mills Road, Elk Mills, MD. Tax Map 21, Parcels 12 & 834 and is presently zoned Business General (BG). 

 

            The property was built in 1867 and consists of a mansion house, smokehouse, carriage house, private residence, barn, garage and several acres of ground.  It is currently utilized as a Bed & Breakfast.

 

            The nomination will be placed on the Board of County Commissioners Agenda for the October 2, 2007 meeting for decision.

 

            - APPOINTMENTS -

 

            Motion was made by Commissioner Lockhart, seconded by Commissioner Guns and unanimously carried to appoint Mark Saunders to the Board of Appeals for a three-year term to expire on 8/30/10.

 

            - ORDINANCE - CHAPTER 200, CECIL COUTNY CODE, BUILDING   CONSTRUCTION - 2006 INTERNATIONAL BUILDING CODE -

 

            Administrator Wein presented the ordinance to repeal, and re-enact certain sections of Chapter 200, Building construction of the Cecil County Code, to replace the 2003 International Building Code and the 2003 International Residential Code with the 2006 International Building Code and the 2006 International Residential Codes, as adopted by the International Code Council and the State of Maryland.  The ordinance was presented at public hearing at the Board's September 4, 2007 meeting.

 

            Motion to adopt was made by Commissioner Demmler, seconded by Commisioner Lockhart and unanimously carried to approve.

 

            -           DEPARTMENT OF PUBLIC WORKS -

 

            W. Scott Flanigan, Director of Public Works presented the following DPW items for consideration:

 

-          BID NO. 08-08 ROADS DIVISION ASPHALT OVERLAY -

           

Upon the recommendation of Mr. Flanigan, motion was made by Commissioner Lockhart seconded by Commissioner Tome and unanimously carried to award Bid No. 08-08 to Edgemoore Materials, Inc., for a total price of $1,834,836.41.

 

-          BID NO. 08-10 U.S ROUTE 40 SEWAGE PUMPING STATION & FORCE MAIN REPLACEMENT PROJECT -

 

            Upon the recommendation of Mr. Flanigan, motion was made by Commissioner Lockhart, seconded by Commissioner Tome and unanimously carried to award Bid No. 08-10 to Stewart & Tate, Inc., in the amount of $1,948,947.00.

 

-          BUDGET AMENDMENT NOS.  - 22 - 29 -   

 

            Motion was made by Commissioner Tome, seconded by Commissioner Lockhart, and unanimously carried to approve Budget Amendments Nos. 122-126.  A copy of these budget amendments are attached hereto and made part of these minutes.

 

            The next regular meeting of the Board of County Commissioners will be held on Tuesday, October 2, 2007 at 7:00 p.m. at the County Administration Building, 107 North Street, Elkton, MD 21921.

 

            There being no further business of the County Commissioners, the meeting concluded.
