MINUTES OF THE BOARD OF COUNTY COMMISSIONERS REZONING HEARING July 3, 2007 The Board of County Commissioners of Cecil County met in regular session at the County Administration Building, 107 North Street, Elkton, MD on Tuesday, July 3, 2007. The following members of the Board were present:
William C. Manlove, President Rebecca J. Demmler, Commissioner Brian Lockhart, Commissioner Commissioner Wayne Tome
Constituting a majority Board. The meeting was called to order by President Manlove at 2:30 p.m. and opened with the Pledge of Allegiance. A Court Reporter recorded a verbatim transcript of this pubic hearing. FILE NO: 2007-4 - Applicant: Kings Way Ninety-Five, Inc. Property Location: Belle Hill Road, Elkton, MD Election District: 3, Tax Map: 303, Parcel: 1130. Presently Zoned: Development Residential, (DR). Request: To rezone approximately 5.509 acres from Development Residential (DR) to Business Intensive (BI). Property Owner: H. Barry Montgomery, President. The application was read, and all witnesses were sworn by Administrator Wein. H. Barry Montgomery, owner of the subject property appeared before the Board in support of the subject rezoning and presented applicant's exhibit #1 a color-coded map and applicant's exhibit #2 an arial photograph of the subject property. Mr. Montogmery presented testimony relative to the location and proposed intended uses as a business flex space. The request is based upon change in the area; as well as mistake in the last comprehensive rezoning. COMMISSIONER'S COMMENTS: Commissioner Demmler questioned the use of the subject property. Mr. Montgomery stated that there are no definite plans for the parcel at this time, however, the proposed use would be for a Doctor's Office, Hair Salon, Vet Center, something of that nature, due to the limited water resource. COMMENTS IN OPPOSITION/SUPPORT: None. Eric Sennstrom, Director of Planning & Zoning advised the Board that the Planning staff's recommendation was for approval of the rezoning based upon change in the character of the neighborhood since the 1993 Comprehensive Rezoning. The Planning Commission has also recommended approval, based upon change. Clifford Houston presented the findings of facts. The decision of the Board will be placed on the Board of County Commissioners Meeting Agenda on July 17, 2007 at 2:00 p.m. in the County Administration Building. With no further business to discuss, the meeting concluded.
