MINUTES OF THE BOARD OF

COUNTY COMMISSIONERS

 

REZONING HEARING

April 7, 2009

 

 

The Board of County Commissioners of Cecil County met for the purpose of a rezoning hearing at the County Administration Building, 200 Chesapeake Blvd., Elkton, MD on Tuesday, April 7, 2009.  The following members of the Board were present:

 

            Brian L. Lockhart, President

            Rebecca J. Demmler, Vice President

            Wayne L. Tome, Sr., Commissioner

            Robert J. Hodge, Commissioner

            James T. Mullin, Commissioner

                                                                                                                       

Constituting a full Board.

 

The meeting was called to order by President Lockhart at 4:30 p.m. and opened with the Pledge of Allegiance.

 

Alfred C. Wein, Jr., County Administrator, swore in all persons presenting testimony.

 

File No. 2009-02 - Applicant: Goss-Montgomery Partnership. Property Location: Telegraph Road-North Side of Route 273, Rising Sun, MD.  Election District: 6, Tax Map: 10, Parcels 81 & 479.  Presently Zoned: Town Residential, (TR). Request:  To rezone 1.173 and 2.89 acres from Town Residential, (TR) to Business General (BG). Property Owner:  H. Barry Montgomery.

 

H. Barry Montgomery appeared before the Board in support of his rezoning request to rezone 1.173 and 2.89 acres located on the north side of Route 273 in Rising Sun, Maryland for the purpose of retail development. 

 

The applicant is basing his request on substantial change in the character of the neighborhood, as a result of multiple residential and commercial development in the surrounding area.

 

Commissioner Hodge commented that he would like to see an intense buffer surrounding the parcel if this rezoning was approved.

 

COMMENTS SUPPORT/OPPOSITION:

 

Diane Marousek, 386 Telegraph Road, Rising Sun - commented in opposition to the rezoning request, she stated that there are many residential properties located in close proximity to the proposed site; and the fact that there are currently several vacant commercial sites in the area.

 

Eric Sennstrom, Director of Planning & Zoning presented the finding of facts; the planning staff recommendation of approval, based upon substantial change; and the Planning Commission's recommendation of approval, based upon substantial change.

 

The Board of County Commissioners will render a decision on this rezoning hearing at their April 21, 2009 meeting.
