MINUTES OF THE BOARD OF COUNTY

COMMISSIONERS MEETING

 

March 2, 2010

 

            The Board of County Commissioners for Cecil County met in regular session at the Cecilton Town Hall, 117 W. Main Street, Cecilton, MD.  The following members of the Board were present:

 

            Brian L. Lockhart, President  

            Rebecca J. Demmler, Vice President

            Wayne L. Tome, Commissioner

            Robert J. Hodge, Commissioner

            James T. Mullin, Commissioner

 

Constituting a full Board.

 

            The Board adjourned into a Closed Session at its work session on February 23, 2010 at 9:45 A.M., motion was made by Commissioner Demmler, seconded by Commissioner Tome and unanimously carried pursuant to MD Annotated Code – State Government 10-508 (a) (1) Personnel matters; (3) Consider the acquisition of real property for a public purpose and matters directly related thereto; (7) Consult with counsel to obtain legal advice; (8) Consult with staff, consultants, or other individuals about pending or potential litigation. Present: Commissioners Lockhart, Demmler, Tome, Hodge and Mullin; H. Norman Wilson, Counsel; Administrator Wein; Director Donna Nichols, Director Scott Flanigan; Budget Manager Whiteford; Denise Davis and Board of Library Trustees.  Topics of Discussion:  Personnel Matters;  Consider the acquisition of property for library and wastewater purposes, consult with counsel to obtain legal advice – Artesian Meadowview Operations Agreement.  Actions Taken:  Reviewed and approved several "request to fills"; Directed Department of Public Works to draft final offer letter to Eric Dunn; Denise Davis and Library Board provided update on property acquisition negotiations relating to North East Library Branch; Directed Department of Public Works to meet with Artesian representatives regarding operations agreement. Meeting adjourned at 11:40 A.M.

 

The meeting of the Board of County Commissioners for Cecil County, March 2, 2010 was called to order by Commissioner Lockhart at 7:00 p.m. and opened with the Pledge of Allegiance.

-COMMISSIONERS' COMMENTS-

 

-          PUBLIC COMMENT –

 

Commissioner Tome –commented on the Board's day in Annapolis, testifying in opposition to the Collective Bargaining Bill and stated that the Board will be returning to Annapolis over the next several weeks to offer additional testimony.

 

Commissioner Hodge – thanked the Town of Chesapeake City for hosting the meeting.  He commented about testimony offered in Annapolis.

 

Commissioner Demmler – also thanked the Town of Chesapeake for hosting the meeting.  She encouraged everyone to keep a mind-full eye on the events taking place in Annapolis with the delegation, and further commented about the Comprehensive Plan Review.

 

Commissioner Mullin – thanked the Town of Chesapeake City.

 

-          PUBLIC HEARINGS –

 

-          TEXT AMENDMENT – SUBDIVISION REGULATIONS, ARTICLE IV, SECTION 4.2.6; ARTICLE IV, SECTION 4.2.15 & TEXT AMENDMENT, ZONING ORDINANCE, ARTICLE IX, SECTION 180 –

 

Eric Sennstrom, Director of Planning & Zoning presented two text amendments to the Cecil County Subdivision Regulations, Article IV, Sections 4.2.6 & 4.2.15 that would amend the present language to allow for the utilization and execution of subdivision agreements.

 

The Planning Commission forwarded a recommendation of approval at their February 16, 2010 meeting.

 

COMMENTS SUPPORT/OPPOSITION – None.

 

The proposed text amendments will be presented to the Board for consideration at the March 16, 2010 Board of County Commissioners meeting.

 

-          TEXT AMENDMENT – MASTER WATER & SEWER PLAN, AMEND SECTION 4.1.9 B  -

 

Director Sennstrom presented a text amendment to the Master Water & Sewer Plan, Section 4.1.9B that proposes to add language relative to a denied access force main that will be constructed for the purpose of serving five properties west of Carpenter's Point Road that are outside of the designated Priority Funding area.

 

The Planning Commission forwarded a recommendation of approval at their February 16, 2010 meeting.

 

COMMENTS SUPPORT/OPPOSITION – None.

 

The proposed text amendment will be presented to the Board for consideration at the March 16, 2010 Board of County Commissioners meeting.

 

-          AMENDMENT TO THE CECIL COUNTY CODE, CHAPTER 265 THROUGH ORDINANCE 2010-02, CECIL COUNTY WATER & SEWER MAIN STANDARD SPECIFICATIONS & DETAILS, SECTION 0100 A & AMENDMENT TO CECIL COUNTY CODE, CHAPTER 242 THROUGH ORDINANCE 2010-03, CECIL COUNTY ROAD CODE & STANDARD SPECIFICATIONS –

 

Scott Flanigan, Director of Public Works and Tim Whittie, Chief, Development Services Division presented a public hearing for proposed amendments to the Cecil County Code, Chapters 265, section 0100 10.A and Chapter 242, section 11.02 amending language in those sections to allow for the utilization and execution of subdivision agreements.

 

COMMENTS SUPPORT/OPPOSITION – None.

 

The proposed ordinances will be presented to the Board for consideration at the March 16, 2010 Board of County Commissioners meeting.

 

PUBLIC COMMENT -

 

Gaylord Moody – commented about capping governmental salaries for individuals in governmental agencies, and the importance of cost containment in health care benefits.

 

Sharon Weygand, Chesapeake City Administrator – commented that the Town of Chesapeake City will be a location site for assistance regarding the 2010 Census.

-          APPOINTMENTS -   

 

Motion was made by Commissioner Demmler, seconded by Commissioner Tome and unanimously carried to re-appoint the following members to the Cecil Partnerships for Children, Youth & Families Board of Directors for a two-year term to expire on March 1, 2012. 

 

-          DEPARTMENT OF PUBLIC WORKS -

 

- DEED BETWEEN THE BOARD OF COUNTY COMMISSIONERS AND RONALD A. GUNS & LINDA L. GUNS AND THE BOARD OF COUNTY COMMISSIONERS –

 

            Upon the recommendation of Director Flanigan, motion to approve the deed for utility and drainage easement between the aforesaid parties was made by Commissioner Hodge, seconded by Commissioner Mullin and unanimously carried.

 

-BUDGET AMENDMENTS NOS.  – 94 - 101      

 

            Motion was made by Commissioner Demmler, seconded by Commissioner Tome and unanimously carried to approve Budget Amendment Nos. 94-101. A copy of these budget amendments are attached hereto and made part of these minutes.

 

            The next regular meeting of the Board of County Commissioners will be on March 16, 2010 at 7:00 p.m. at the Cecil County Administration Bldg., 200 Chesapeake Blvd., Elkton, MD  21921.

 

There being no further business of the County Commissioners, the meeting was adjourned.

 

The Cecil County Board of Health met at the County Administrative Building, 200 Chesapeake Blvd., Elkton, Maryland on Tuesday, February 2, 2010.  The following members of the Board were present:

            Wayne L. Tome, Sr., Commissioner

            Robert J. Hodge, Commissioner

            James T. Mullin, Commissioner

            Stephanie Garrity, Health Officer

 

            Constituting a full Board.

 

 

Health Officer Garrity updated the Board on the H1N1 flu virus and advised that there is still plenty of vaccine available at the Cecil County Health Department.  There is an open clinic every Tuesday from 2:00 p.m. to 6:00 p.m. and there is no charge for the vaccine.

 

The Cecil County Health Department is encouraging every household to "step up and get counted" and to participate in the 2010 Census.  Representatives will be available at the Health Department in mid March through April, to assist individuals in filling out their census forms should they require assistance.
