MINUTES OF THE BOARD OF
COUNTY COMMISSIONERS
REZONING HEARING
January 9, 2007
The Board of County Commissioners of Cecil County met in regular session at the County Administration Building, 107 North Street, Elkton, MD on Tuesday, January 9, 2007. The following members of the Board were present:
William C. Manlove, President
Rebecca J. Demmler, Commissioner
Brian Lockhart, Commissioner
Wayne L. Tome, Sr., Commissioner
constituting a quorum.
The meeting was called to order by President Manlove at 2:00 p.m. and opened with the Pledge of Allegiance.
Linda Prince, Court Reporter, recorded a verbatim transcript of this pubic hearing.
FILE NO: 2006-12. Applicant: Ronald & Linda Guns. Property Location: Tony's Road, Elkton, MD. Election District: 3, Tax Map: 19, Parcel: 144. Presently Zoned: Northern Agricultural Residential, (NAR). Request: To rezone approximately 9.77 acres from Northern Agricultural Residential to Rural Residential (RR). Property Owner: Ronald A. & Linda Guns.
President Manlove stated that Vice President Guns would not be present for this hearing, due to his relationship with the applicant.
The application was read, and all witnesses were sworn.
Ronald Guns, Property Owner, appeared before the Board in support of this application to rezone 9.77 acres located on Tony's Road, Elkton, MD from Northern Agricultural Residential (NAR) to Rural Residential (RR). The applicants wish to give their two remaining children, who currently do not reside at this location, building lots in which to build future homes at this location and as a result of the Transfer of Development Ordinance which took effect on January 1, 2007 is not able to do so unless the property is rezoned.
Mr. Guns has based his request on a mistake in the 1993 Comprehensive Rezoning Plan and change in the area.
COMMISSIONER'S COMMENTS:
Commissioner Demmler stated that she does not feel as though a rezoning is necessary as a result of the applicant's current application for subdivision. She further stated that due to the large amount of surrounding land zoned Northern Agricultural Residential, rezoning could not be justified at this time.
COMMENTS IN OPPOSITION/SUPPORT: None.
Director Sennstrom, Office of Planning & Zoning advised that the staff recommendation was for approval, due to a mistake in the 1993 Comprehensive Rezoning.
The Planning Commission recommended approval, based upon a mistake in the 1993 Comprehensive Rezoning.
Director Sennstrom read the Findings of Facts.
Motion was made by Commissioner Lockhart, seconded by Commissioner Tome and carried by a majority vote to approve the rezoning request.

With no further business to discuss, the meeting concluded.
